01Overview
Crowdstake provides an AI-powered platform (the "Platform") that turns a customer's ("Customer," "you") website, documents, competitor intelligence, and market signals into a structured, cited knowledge base. The Platform benchmarks your pages against your ideal customers, audits them for gaps across search and AI-answer surfaces, and makes the results available to you, your team, and your connected AI agents through an MCP server and related interfaces.
By using Crowdstake, you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the Platform.
02Eligibility
You must be at least 18 years old to use the Platform. By registering, you represent that all information you provide is truthful and accurate and that you have the authority to bind any organization you represent.
03Crowdstake's Role
Crowdstake provides software tools and infrastructure that analyze your website and related content and make the results available to you and your connected AI agents.
Crowdstake is a software-as-a-service provider. It is not a marketing, SEO, or legal advisor, and its outputs are analyses and recommendations, not guarantees of any ranking, visibility, or business result.
Subscription fees and usage credits are billed through our third-party payment processor. Crowdstake never stores full credit card details or direct payment data.
04Customer Responsibilities
You are solely responsible for:
- Ensuring you have the rights to any website content, documents, or data you submit to the Platform for analysis.
- Reviewing Crowdstake's outputs before relying on, publishing, or acting on them; AI-generated analyses and recommendations may contain errors.
- Complying with all applicable laws and regulations, including those governing data protection, marketing, and intellectual property.
Crowdstake does not guarantee any particular ranking, visibility, traffic, or business outcome.
05AI-Generated Content
The Platform uses AI models to generate analyses, recommendations, rewrites, and other outputs based on the data you provide.
You retain ownership of your original content.
Crowdstake retains a limited license to process, host, and use your content to provide and improve the service.
AI outputs are provided "as-is" without warranty of accuracy, originality, or fitness for purpose.
06Data Collection and Privacy
By using the Platform, you grant Crowdstake AI, Inc. the right to collect, process, and store data related to your website, documents, and use of the Platform.
Data handling practices are described in detail in our Privacy Policy.
07Fees and Payments
Crowdstake offers subscription plans and usage-based credits. Any applicable fees are disclosed prior to purchase. Crowdstake reserves the right to modify its pricing or fee structure with reasonable notice.
08Prohibited Uses
You agree not to:
- Use the Platform for illegal, harmful, or fraudulent activities
- Collect or distribute personal data without consent
- Interfere with system security, reverse engineer, or scrape our platform
- Submit content you do not have the rights to, or use the Platform to infringe the intellectual property or privacy of others
Violation may result in account suspension or termination.
09Intellectual Property
All software, branding, and design elements of Crowdstake remain the exclusive property of Crowdstake AI, Inc. You may not use our trademarks or copy platform elements without written permission.
10Disclaimers and Limitation of Liability
The Platform is provided "AS IS."
Crowdstake disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.
To the fullest extent permitted by law, Crowdstake's liability shall not exceed the amount you paid (if any) for platform access in the 12 months prior to the claim.
11Indemnification
You agree to indemnify and hold harmless Crowdstake AI, Inc. from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your content, or your violation of these Terms.
12Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles.
Disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association.
EU or UK users may alternatively seek resolution in their local jurisdiction under applicable consumer protection laws.
13Modifications
We may modify these Terms at any time. Updates take effect when posted on our website. Continued use of the Platform constitutes acceptance of the revised Terms.
